My spouse passed away recently and I’m appointed as an executer under his will, do I have to act?

✦ No, you do not have to act just because you are named in the will – you can renounce the role – but if you want to renounce you must do so before you take any action as executor.

✦ It’s worth reviewing a will and getting legal advice, if required, to make sure that the provisions of a will are properly understood. There are many questions the appointed executors need to answer prior to choosing whether they want/can act as an executor under a will or not. ❓❓❓

✦ For example: Do I have a conflict of interest? Do I want to make a Family Law Act or dependent’s relief claim instead of inheriting under the will? Do I object to any portion of the will or want to challenge it? Can I work with the co-executors?
